BipAgents terms of use
Last updated: 24 October 2026.
1. Purpose
These terms govern the use of the BipAgents app for iPhone, iPad and Android ("the app"), published by Kerfy Studio. You accept these terms by confirming the first-launch screen ("I accept" button), which sums up the essentials (your agents are AIs, they act with your OK, where your data goes, how to report a reply) and gives access to their full text and to the privacy policy. With "Demo only", you only try the built-in demo (section 12), without connecting an agent. If you subscribe to the all-included offer, its terms of sale and its acceptable use policy apply as well. These texts, the privacy policy and the mentions légales (legal notice) remain available in Settings › About.
2. Publisher
Kerfy Studio, a French SAS with a share capital of 1000 €, registered office: 47 rue Vivienne, 75002 Paris, registered with the RCS of Paris under number 131834921, phone: , publication director: Alexandre Duthil, president. Contact: support@bipagents.com; abuse reports: abuse@bipagents.com. See also the mentions légales (in French).
3. What BipAgents does
- BipAgents is an app to talk to your own AI agents: write to them, send them voice notes, talk with them in Live, get their replies and approval requests as notifications, exchange files.
- BipAgents is built on Hermes Agent, open-source software by Nous Research (https://github.com/NousResearch/hermes-agent). Nous Research does not publish the app and is not responsible for it; Kerfy Studio is not answerable for Hermes Agent itself, only for the changes BipAgents' installer makes to it. BipAgents is an independent app: it is not published, endorsed or sponsored by Nous Research, and it has no link with the owners of trademarks with the same name.
- Your agents run in one of two ways:
- on your computer or server, which you install and manage yourself, with the AI model you chose (a cloud API or a local model); the app connects to them through Tailscale or your local network;
- with the all-included offer, which is paid, on your place, an account on a server that Kerfy Studio rents from a hosting partner, with AI credit included; it is governed by its terms of sale.
- With your own server, Kerfy Studio does not host your agents, does not provide the AI model and has no access to your conversations. Its role is then limited to publishing the app and running a relay to Apple and Google for notifications (see section 13 and the privacy policy). With the all-included offer, Kerfy Studio hosts your place and gives you access to the AI model, without accessing the content of your place (terms of the offer, section 9).
4. Minimum age
To use BipAgents, you must be at least 16. Between 16 and 18, you need a parent's agreement, and the minimum age set by your model provider applies to you. A child under 16 may only use the app on an install set up and supervised by a parent or an adult in charge of the child (the family feature): that adult accepts these terms for the child and remains responsible for the child's use. This age follows the app's App Store rating (16+), due to the unrestricted web access of the Desktop view. For the all-included offer, see also its terms (section 7).
5. Price
The app is free to download and to use with your own computer or server, with no ads. What you then need to use it remains at your own cost: your computer or server, its hosting, your model provider, your Internet access and, if any, your Tailscale account.
Kerfy Studio also offers a paid offer, the all-included offer (Solo, Duo and Family plans, and extra AI credit), sold as a subscription in the app, on the App Store and Google Play. Its prices and rules are in its terms of sale.
Partner links (later). If the app or the kerfystudio.com website ever suggest hosting providers through partner links, these links will be marked "Partner link": if you sign up, Kerfy Studio may receive a commission, without your price changing. Before the first link, these terms will state the criteria by which hosting providers are presented and whether any payment influences their order; this change will be announced as provided in section 19.
6. Licence and open source
- BipAgents' source code is published under the MIT licence: https://github.com/Alexbob0/BipAgents. You may use, copy, modify and redistribute it under that licence, which prevails over these terms for everything about the source code.
- The Bips themselves are not under the MIT licence: their drawings, the app's icon, their babble, their voices, the demo's recordings (the podcast, recorded with Fish Audio Drama 3 — "Built with Fish Audio") and the screenshots. You may show them to present BipAgents and build BipAgents with them, not reuse them in another app or product (the repository's LICENSE-ASSETS file).
- Third-party components (Hermes Agent, fonts, Kyutai's voice models…) remain under their own licences, listed in the repository.
- The MIT licence covers the code; it does not give you the right to use the names "BipAgents" and "Kerfy Studio" to present another product as ours.
- Version downloaded from the App Store: Apple's standard Licensed Application End User License Agreement applies in addition to these terms. These terms are between you and Kerfy Studio, not Apple; Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it.
- Version downloaded from Google Play: the Google Play Terms of Service also apply.
7. Your server, your model, your accounts
If you use your own computer or server, you are responsible for:
- installing, securing, updating and backing up your server, and choosing its hosting provider;
- keeping your keys private: an install's QR code contains your agents' keys, show it to your own phone only;
- complying with your model provider's terms (permitted uses, minimum age, costs) and those of the services you connect to your agents (email, banking, smart home, websites);
- if you administer a server for other people (the family feature), the installs you create for them: tell them what you can see or do on the server, do not read their conversations without their agreement and, for a minor, adapt the agents, their access (email, browsing, purchases) and the model to their age.
With the all-included offer, Kerfy Studio takes care of the server, its updates and your place's backups; you remain responsible for your devices, your recovery code, complying with the terms of the services you connect to your agents and what you do over SSH (terms of the offer).
8. What AI can and cannot do
- Your agents are artificial intelligence systems, not people. The app tells you so on first launch, with the "AI" badge next to their name, at the start of each Live session, and in notifications and the widget.
- Their replies are generated by an AI model. They can be wrong, incomplete, outdated or inappropriate, and a model can confidently make facts up.
- They are not a substitute for professional advice (health, finance, law…). The demo's agents (Coach, Budget…) are illustrations. Check what matters before acting; in an emergency, call emergency services (112 in Europe).
- BipAgents is not a medical device and makes no diagnosis. It does not provide investment advice. What an agent says about sleep, health, a budget or spending remains general information produced by an AI.
- The audio files your agents create, such as podcasts, carry in their metadata a machine-readable mark stating that they were generated by an AI.
- Kerfy Studio controls neither the model you chose nor what it produces.
9. Agents that act, with your OK
- Depending on the tools you give them, your agents can act: send emails, browse and fill in forms, handle files, control your smart home, run commands on your server.
- Before a sensitive action, the agent asks for your approval (Once, This session or Deny), in the app or from the notification. When BipAgents installs Hermes Agent, risky commands always ask you (a Hermes Agent you already had keeps its own settings), and the app does not offer "Always allow". You decide: read the request before accepting. You are responsible for what you approve.
- Depending on your Hermes Agent configuration and installed tools, some actions may happen without an approval request. What your agents read (web pages, emails, files) may contain hidden instructions meant to hijack them: keep approvals on and give each agent only the access it needs.
- The emails and messages your agents send to other people state by default that they were written by an AI agent, and on whose behalf. Do not remove this statement to make people believe a human wrote them.
10. Acceptable use
You agree not to use the app or your agents to:
- break the law, or help anyone do so;
- harm others, harass, threaten, discriminate or incite hatred;
- collect personal data without a legal basis, or monitor someone without their knowledge;
- record other people's words, or have your agents listen to them, without their knowledge (article 226-1 of the French Criminal Code);
- have a synthetic voice imitate a real person, or pass off AI-generated content as authentic;
- infringe the rights of others (copyright, trademarks, image, privacy);
- commit fraud, phish, send spam or impersonate anyone;
- create or spread malware, attack systems or get around their protections;
- produce or spread illegal content, in particular child sexual abuse material;
- abuse the notification relay (overload it, get around its limits, use it to reach devices that are not yours);
- breach the terms of your model provider, of the services your agents use, of Apple or of Google.
You are responsible for what you ask your agents and for what they do with your approval. If you use your agents in a professional context, the obligations of the "deployer" under the European regulation on AI, in particular for deep fakes, apply to you.
With the all-included offer, the acceptable use policy sets out these rules for your place (spam, attacks, cryptocurrency mining, reselling…) and says how to report abuse: abuse@bipagents.com.
11. Reporting content
- In the app: long press a reply › Report this reply. The report goes from the app, through Kerfy Studio's relay, to Kerfy Studio only, with the reply's text; if the relay does not answer, the app offers to send it by email. Also tell your agent so it doesn't do it again.
- Or write to support@bipagents.com.
Your agents' replies are produced on your server, or on your place with the all-included offer, by the chosen model: Kerfy Studio does not read them and does not intervene in them. Reports help us improve the app, its defaults and its documentation, and warn the projects concerned when useful.
12. The demo
The built-in demo is simulated on your phone, with no account and no server. Its agents, people, places, brands, amounts and data are fictional; it illustrates what agents can do, without reflecting exactly what a real agent will do or the quality of a given model. Its podcast voices were recorded with Fish Audio Drama 3 ("Built with Fish Audio").
13. The notification relay: rules and contacts
The relay forwards your server's notifications to your phone: it is a "mere conduit" service within the meaning of Regulation (EU) 2022/2065 on digital services. It also forwards to Kerfy Studio the reports sent from the app (section 11).
- What it accepts: the agent's name, a generic text and technical identifiers. Any other text is automatically replaced with a generic text; no content is kept.
- Limits: quotas per device and per server; beyond them, notifications are refused.
- Blocking: in case of a breach of section 10, Kerfy Studio may refuse the notifications of a device or a server; this decision is made by a person. You can contest it by writing to the point of contact.
- Points of contact (articles 11 and 12 of the regulation): for authorities, contact@kerfystudio.com; for users, support@bipagents.com; or by post to Kerfy Studio, 47 rue Vivienne, 75002 Paris. Languages: French, English. To report abuse coming from a server of the all-included offer: abuse@bipagents.com (acceptable use policy).
The relay is provided on a best-effort basis. It depends on Apple and Google and may be interrupted, in particular for maintenance or in case of abuse. Do not rely on a notification for a life-critical alert.
14. Changes and availability
The app changes with the versions of Hermes Agent, iOS and Android. Kerfy Studio may change it for technical, security or compatibility reasons, at no cost to you. If a change removes an important feature, or if Kerfy Studio stops distributing the app or running the relay, you are told in the app at least 30 days in advance, except for a security emergency, a decision by Apple or Google, or a legal obligation. Compatibility is checked with the Hermes Agent version tested by BipAgents' installer. The source code remains available under the MIT licence. For the all-included offer, see also its terms (sections 11 and 13).
15. Your content
Your messages, files and recordings belong to you. Kerfy Studio claims no right over them and does not receive them, except what you choose to send us (email to support, report). With the all-included offer, they are on your place, which Kerfy Studio hosts without accessing it.
16. Warranty
The app itself is free. Kerfy Studio does its best to keep it in working order, without guaranteeing that it will work without interruption or error, that it will be compatible with every server configuration or every model, or that the agents' replies will be accurate: they are produced by the model you chose. You keep the rights the law gives you as a consumer, in particular, where they apply, those of the legal guarantee of conformity for digital content and services (articles L224-25-12 and following of the French Consumer Code). The guarantee of the all-included offer is set out in its terms (section 13).
17. Liability
Kerfy Studio is liable for damage caused by a failure to meet its obligations, under the general rules of law. It is not liable for what does not depend on it, in particular:
- content produced by the AI model you chose;
- actions of your agents that you approved or that your Hermes Agent configuration allows, unless they result from a defect of the app;
- if you use your own server, that server, its hosting provider, your model provider and Tailscale;
- Apple, Google or the services connected to your agents;
- loss of data on your server or your phone that does not result from a defect of the app.
For the all-included offer, Kerfy Studio's liability is set out in its terms (section 14).
18. Term and termination
These terms apply as long as you use the app. You can end them at any time, by withdrawing your acceptance in Settings or by uninstalling the app. Kerfy Studio may refuse at the relay the notifications of a device or a server that does not comply with section 10; except in an emergency, it tells you and you can contest (section 13). Withdrawing your acceptance or uninstalling the app does not cancel a subscription to the all-included offer: it is cancelled in the store (terms of the offer, section 11).
19. Changes to these terms
Kerfy Studio may change these terms, for instance to follow the law or a change in the app. For a significant change, you are told in the app at least 30 days before it applies, with a summary; other changes are dated at the top of the page. If you do not agree, you can stop using the app and uninstall it at any time, at no cost.
20. Governing law and disputes
These terms are governed by French law. If you are a consumer living in another country of the European Union, you also keep the protection of that country's mandatory rules. In case of a dispute, first write to us at support@bipagents.com to look for an amicable solution. If you are a consumer, you may go, as you choose, to the court where you live or to the court of Kerfy Studio's registered office (in France, also the court of the place where you lived when you accepted these terms or when the damage occurred); Kerfy Studio may only bring an action against you before the court where you live. For the free use of the app, the consumer mediation of articles L611-1 and following of the French Consumer Code, which is reserved for contracts concluded for a price, does not apply; for the all-included offer, its terms name the consumer mediator (section 16).
