Acceptable use policy of the all-included offer
Last updated: 24 October 2026.
1. What it is for
With the all-included offer, your agents run on your place, an account on a server that Kerfy Studio rents from a hosting partner (OVHcloud, Hetzner) and often shares with other people. Kerfy Studio must follow these hosting providers' rules: abuse coming from one place can get the whole server cut off, and with it the other people's places. This policy says what is forbidden, how to report abuse and what Kerfy Studio does. It is part of the terms of the offer and adds to the rules on use in the terms of use (section 10), which apply to the whole app.
2. What is forbidden
You agree not to use your place, your agents or your AI credit, nor let anyone do so, for:
- illegal use: anything French law or the law of your country forbids, or helping anyone do it;
- spam and mass mailing: unsolicited emails or messages, bulk sending, bought mailing lists, open mail relays;
- attacks and scanning: scanning ports or looking for flaws on systems that are not yours, denial-of-service attacks, password guessing in bulk, exploiting flaws, networks of hijacked machines, phishing pages, hosting or spreading malware;
- cryptocurrency mining, or any use designed to hog the server's processor, memory, disk or network;
- content illegal towards minors: any child sexual abuse material or sexual content involving a minor, and any pornographic or violent content made accessible to a minor (articles 227-23 and 227-24 of the French Criminal Code);
- getting around protections: CAPTCHAs, rate limits, access controls or other protections of a website or a service, including through your agents;
- reselling your place: renting it out, reselling it or offering it as a service to others, the place or your AI credit (each person in a Duo or Family plan has their own);
- breaking out of your place: trying to access other people's places, to obtain administrator rights or to get around the separation between the server's accounts.
When your agents browse or use an online service, they must respect that website's or service's terms of use and the rights of others: you are answerable for it.
3. Your responsibility
You are answerable for what you do and what your agents do from your place, with your approval or because your configuration allows it, including through SSH access. What your agents read (web pages, emails, files) may contain hidden instructions meant to hijack them: keep approvals on and give each agent only the access it needs (terms of use, section 9).
4. Reporting abuse
Anyone can report abuse coming from a server of the offer, even without using BipAgents, and so can hosting providers and authorities.
- Where: abuse@bipagents.com, or by post to Kerfy Studio, 47 rue Vivienne, 75002 Paris. Languages: French, English. Authorities can also use the point of contact contact@kerfystudio.com (Regulation (EU) 2022/2065, articles 11 and 12).
- What (article 16 of Regulation (EU) 2022/2065):
- why you consider it illegal or abusive;
- where to find it: the server's IP address, the date and time with the time zone, the web address, an email's headers or a log extract;
- your name and email address, except for a report of child sexual abuse;
- a statement confirming that you believe, in good faith, that this information is accurate and complete.
- Then: we acknowledge receipt without delay and tell you what we decided.
For a reply from your own agents that bothers you, use "Report this reply" in the app instead (terms of use, section 11). If someone's life or safety is threatened, first call emergency services (112 in Europe).
5. What Kerfy Studio does
- Kerfy Studio does not read the places. To handle a report, it uses what the report contains and the technical data it already has (which server and which place, at what time), never the content of the place.
- Quick suspension: on a hosting provider's report, on a legal request or in front of serious abuse in progress (an attack, spam being sent), Kerfy Studio may at once cut the place's AI key and suspend the place, before any exchange, to stop the abuse and protect the other people on the server. This decision is made by a person.
- Reasons: Kerfy Studio tells you without delay what was done, why (the facts, the rule at stake) and how to contest it, unless the law or an authority forbids it (article 17 of Regulation (EU) 2022/2065).
- Contesting: reply to that message or write to abuse@bipagents.com. A person reviews the decision. If the abuse came from a hijacked agent or stolen access, we help you put your place back in order; if the suspension was not justified, your place is restored as soon as possible.
- End of the subscription: for a serious or repeated breach, Kerfy Studio may end the subscription, after giving you formal notice to stop, except in an emergency or for a particularly serious breach (terms of the offer, section 11).
- Authorities: Kerfy Studio answers the orders and requests from authorities that the law provides for, and tells them without delay if it learns of an offence that threatens someone's life or safety (article 18 of Regulation (EU) 2022/2065).
- Retention: reports and decisions are kept 1 year after they were handled, longer if a dispute or proceedings require it (privacy policy, section 5.7).
